China’s growing appetite for global power isn’t hard to spot: military muscle-flexing in the South China Sea, the trillion-dollar New Silk Road development initiative, even its proliferation of Confucius Institutes, academic outposts to spread its version of history and politics.

What’s less easy to see is that worsening human rights violations at home are increasingly reflected in Beijing’s diplomatic agenda to undermine human rights protections abroad, including at the United Nations.

The U.N. human rights system exists to protect people whose own governments cannot or will not do that for them.  The system has many shortcomings, but even so it is a vital international forum for monitoring nations’ compliance with their human rights obligations, where critical independent voices can be heard and violators at times held accountable—or at least spotlighted. 

For activists who work on China human rights issues, this venue is all the more important because the country’s president, Xi Jinping, has steadily strangled domestic options for obtaining justice through the courts and engaging in peaceful dissent.

Chinese authorities have prevented mainland activists from reaching the U.N. Human Rights Council in Geneva and harassed them at U.N. headquarters in New York. Chinese officials in Geneva have even threatened foreign diplomats and UN. human rights experts who support scrutiny of Beijing’s record.

As a new Human Rights Watch report exposes, President Xi’s government is working hard to weaken these U.N. mechanisms. Chinese authorities have prevented mainland activists from reaching the U.N. Human Rights Council in Geneva and harassed them at U.N. headquarters in New York. Chinese officials in Geneva have even threatened foreign diplomats and U.N. human rights experts who support scrutiny of Beijing’s record. 

Reflecting its hostility to human rights monitoring generally, China has also blocked U.N. resolutions supporting human rights defenders globally—thus undermining protections for rights groups who do not even work on China.

Beijing is also trying to manipulate U.N. mechanisms to impose its political views on others. China—along with other countries hostile to human rights—sits on the U.N. committee that grants civil society groups accreditation needed to participate in U.N. meetings. Applicants have been told that getting approval means deleting from their organizations’ materials any reference to 2010 Nobel Peace Prize winner Liu Xiaobo. Any references to Taiwan or Tibet must reflect Beijing’s view that those territories are part of China. 

China has jailed activists who wanted to participate in U.N. activities, and even blocked a commemoration of one who died trying to do so. 

In September 2013, Chinese authorities detained Cao Shunli, a Beijing-based activist, prior to boarding a flight for Geneva, where she was going to participate in China-related U.N. training sessions.  While in detention Cao fell critically ill, but the authorities denied her adequate medical care. She died in March 2014.

At the next session of the U.N. Human Rights Council, nongovernmental organizations sought to hold a moment of silence in her honor, but China coolly and cruelly succeeded in getting enough other Council members—including Cuba, Russia, Iran, Saudi Arabia and Venezuela– to prevent the gesture.

U.N. officials have at times rejected Chinese efforts at intimidation and ensured that independent voices are heard.  Yet on other occasions they either fail to stand firm—allowing, for example, China to dictate that experts seen as critical of China not sit on key committees—or, worse, are complicit in abuses.

 In April 2017, U.N. security officers forced Dolkun Isa, an accredited activist for China’s persecuted Uyghurs, to leave the New York headquarters, where he was participating in a conference on minority rights.  When challenged about this incident, Secretary-General Antonio Guterres said he was “fully aware of the situation,” but failed to offer any explanation or plan of action to change things.

To be sure, China isn’t the only government that seeks to manipulate the U.N. human rights system for its own benefit.  But Beijing’s global power, ambitions, and its status as a permanent member of the U.N. Security Council make it a sinister role model for other authoritarian governments. 

China’s ability to block human rights initiatives is not absolute.  The U.N. remains a high profile venue for countries intent on promoting human rights and for working to hold abusive governments to account.  In March 2016, for example, the United States and 11 other countries issued an unprecedented joint statement condemning China’s arrest of human rights activists and attorneys. 

Nonetheless, the trend is moving in the wrong direction. As Human Rights Watch’s research has shown, unless the U.N., with help from rights-respecting governments, pushes back by insisting on compliance with established human rights practices, adopting new ones to prevent future abuses, and holding China and other bad-faith players accountable, the integrity of the vulnerable U.N. human rights system—and the people around the world it helps to protect—are at grave risk.

‘They would hang me up for several hours with my hands tied to a rope…once I was beaten continuously for two days with nothing to eat nor a drop of water to drink,’ said Labrang Jigme, a Tibetan monk arrested for peaceful protesting in Tibet. ‘The second time I was unconscious for six days unable to open my eyes or speak a word.’

Upon being released, Jigme was forced to sign a document stating that he was not tortured.

According to International Campaign for Tibet (ICT), massive peaceful protests in 2008 led to an intensive crackdown on the country with more than 600 Tibetans imprisoned and approximately 150 self-immolations – Tibetans light themselves on fire as an individual form of protests against oppression.

‘The Chinese government fears that if they don’t completely crush any form of protest they will lose control of Tibetans,’ said Executive Director of International Campaign for Tibet (ICT) Europe, Tsering Jampa. ‘Instead of trying to assess why Tibetans self-immolate and change the situation, they come down harder and more fierce each time.’

Recent evidence shows that there has been a significant increase of Tibetan political prisoners since the protests, and torture has become more widespread than ever. Because of these outstanding cases, in November 2015, the United Nations Committee against Torture (CAT) met with China officials and asked them to account for ‘deeply entrenched’ torture and ill treatment, according to a published report by ICT.

‘It (the report) also reflects alarm at China’s attempts to subvert criticism of its record on human rights and to distort the reality,’ said Executive Director of ICT Germany, Kai Mueller. For example, when ICT brought forward torture devices that were used on prisoners, Chinese officials argued they were made comfortable with cushions so they could no longer be considered torture devices.

‘We had a Tibetan monk who was able to escape prison, testify and show examples of the torture devices that were used on him,’ Jampa said. ‘Chinese officials refused to acknowledge this case and many other cases brought before them.’

Another case brought before CAT included a Tibetan man who was shot and killed while trying to intervene on behalf of an elderly monk who was beaten with an iron rod in the prison. The elderly man later died of what Chinese officials called ‘natural causes’ even though his body showed obvious signs of torture and brutal beatings.

China refused to acknowledge these cases because of the ‘unverifiable nature of information’. CAT strongly urged China to provide more insight on these brutal cases, which have created a lot of distress among Tibetans.

China has been able to continue and intensify their control because they have successfully closed Tibet off from the rest of the world. So during the UN’s confrontation with China, ICT, which focuses on monitoring and reporting on Tibetan human rights and advocating for Tibetans imprisoned for their political or religious beliefs, ran a campaign in the Netherlands against torture in Tibet. This was to raise awareness about the abuse that Tibetans are subjected to and to gather signatures to put pressure on European government officials who would then put pressure on the Chinese government.

International Campaign for Tibet has helped several prisoners such as Ngawang Sangdrol, Phuntsog Nyidron and Dhondup Wangchen get released; each who share horrific stories of their imprisonment.

China refuses to give up Tibet due to its strategic location, land space, natural resources, and the fact that there are now more Chinese in Tibet than Tibetans because of immigration. Therefore, the Dalai Lama – Tibetans’ spiritual leader currently living in exile in India – has pleaded with the Chinese government to make Tibet truly autonomous so people can have freedom of speech, religion, and movement.

‘The Dalai Lama is not asking that the Chinese leave, we know it is too late for that,’ Sangpo said. ‘He is simply asking that Tibetans have the same rights and freedom as the Chinese have.

Excerpt: The “Repeal PRWORA Project” advocates for the repeal of Public Law 104-193, also known as the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) signed by US President Bill Clinton in 1996. The organizers argue that this law reintroduced varieties of slavery, including involuntary servitude and forced labor, by unfairly denying retirement income benefits to non-citizen taxpayers who cannot provide proof of lawful residency. Critics claim this law infringes on the constitutional rights of these workers, violating principles of equal treatment, protection, and justice under law. They demand for a strict adherence to the natural law principles abolishing any form of slavery.

President Clinton’s New Beginning in 1996 – Trampling of Human Dignity of Alien Workers during the Final Stretch of Life

On August 22, 1996, US President Bill Clinton (Democrat) signed into Law that reintroduced Slavery, Involuntary Servitude, Serfdom and Forced Labor in the pretext of making ‘A New Beginning’. Welfare Reform Act or Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) is unjust and unfair for it violates Constitutional Law that defends natural rights of all people living in the United States. All US taxpayers must be treated as equals for receiving retirement income benefits for which they paid taxes. President Clinton’s action constitutes a transgression of President Abraham Lincoln’s Emancipation Proclamation that saved US Non-Citizens or Aliens from the indignity of Slavery.

I ask my readers to review 43-word 13th Amendment and tell me if those words still govern, rule, and operate the lives of all people, wage earners who perform labor paying taxes.

My readers should not be surprised if I describe the US Congress as “Slave Driver.” The reason for my claim is based on PRWORA enacted by the US Congress in 1996 that amended The US Social Security Act of 1935. This legal provision enacted by 104th US Congress is incorporated as Section 202(y) of the Social Security Act. It mandates that no Retirement Income benefits shall be payable to registered alien (non-citizen) taxpayers in the United States without showing proof of lawful residency as determined by the Attorney General. In my view, the fundamental concern is about upholding the US Labor Laws that grant the opportunity of Equal Treatment at the US Workplace. All US taxpayers laboring on the US soil must be treated with human dignity and provided with economic security if a worker has attained the full retirement age as determined by law.

Social Security Act, Section 202(y) violates the principle enshrined in those 43 words called the 13th Amendment. This 1996 amendment to the Social Security Act is fundamentally flawed for it is unconstitutional. It takes away the property rights (earnings, wages, and retirement income) of individuals who paid Federal, State, Local, Social Security and Medicare Taxes working in this country to attain the full retirement age.

The Emancipation Proclamation issued by President Abraham Lincoln (Republican) in September 1862 came into effect on January 01, 1863 freeing slaves in all territory still at War with the Union. These slaves were not citizens of the Land and had no political rights of their own. In Law, Servitude or Slavery refers to the burden imposed upon the property of a person by a specified right another has in its use. Servitude involves labor in which the person who performs labor has no right to his earnings from labor. The Emancipation Proclamation specifically protects, defends, preserves and safeguards rights of aliens or non-citizens residing in the United States.

The amended Social Security Act unconstitutionally gives power to Social Security Administration to withhold property (wages, earnings, monthly retirement income benefits) of alien workers who are not convicted by US Court of Law. In my analysis, The Social Security Act of 1935 amended in 1996 fails to uphold the US Constitution as the Supreme Law of this Land.

I ask my readers to make the distinction between Social Security Tax and Monthly Retirement Benefit. The first represents tax paid to the government and the second represents earning or wage entitled to a retired person to provide income, and security during old age.

President Clinton’s Slavery Law of 1996 tramples upon fundamental freedoms and human dignity entitled to all human beings without any concern for their country of origin or citizenship status. The US Congress can levy taxes but cannot deprive any person of Life, Liberty and Property without due process of Law.

The “Ten Commandments” are given in the Book of Exodus, The Second Book of Moses, The Old Testament of Holy Bible and are repeated in the Book of Deuteronomy,The Fifth Book of Moses. In Exodus, Chapter 20, verses 1-5 read as follows:

And God spoke all these words, saying:

2. “I am the LORD your God, who brought you out of the land of Egypt, out of the house of bondage”.

3. “You shall have no other gods before Me.”

4. “You shall not make for yourself a carved image-any likeness of anything that is in heaven above, or that is in the earth beneath, or that is in the water under the earth.”

5. “You shall not bow down to them nor serve them. For I, the LORD your God, am a jealous God, visiting the iniquity of the fathers upon the children to the third and fourth generations of those who hate Me.”

The ideas and thoughts that are expressed in the above Commandments basically oppose attitudes and personal behaviors which constitute and define Indian Identity. If I accept the Ten Commandments, even the simple practice of traditional greeting of “Namaskar” would be prohibited. I greet my God with ‘Namaskar’ and so also I greet my parents, my teacher, my guests, the Sun, the Light, the river, the mountain, the monkey, the cow, the plant, the tree, the rock, the idol with the same reverence and in the same way.

The term ‘omnipresent’, being present everywhere at the same time describes God’s Absolute nature and Indians are culturally driven to seek divinity in all living objects and in all objects of this created world and universe. I touch and worship feet, I worship the fire, the water, the sky and the earth. I have a complete freedom of choice. I choose the object that I want to worship and do it at a time, place and manner that appeals to my free will.The Commandments intend to take away that freedom of expression and the manner in which I worship God.

I expressed my concerns about “The Ten Commandments” in an essay that was published in ‘The Ann Arbor News‘ in its daily edition dated Wednesday, March 1, 2000. I am reproducing the “OTHER VOICES” essay:

Indiana on verge of imposing religion on people

The Ten Commandments and the imposition of Religion on people.

I am indeed distressed to read the news report from Indiana announcing that the state House as well as the Senate had overwhelmingly approved a bill that would permit the display of the Ten Commandments at public buildings, including schools.

This is not a trivial matter. That state is on the verge of imposing religion upon its people. A similar bill was introduced in the U.S. Congress during 1999. The idea of displaying the Ten Commandments is receiving widespread support from the conservative Christians. I am shocked there has been no public opposition to such bills apart from a small concern about violating the spirit of the U.S. Constitution.

Indiana state Rep. Jerry Denbo assumed that the Ten Commandments are not bad principles. Unfortunately, most Christians presume that the Ten Commandments are divine law and that they are benign and noncontroversial principles. Many proponents of these bills also believe that they can prevent juvenile crime and violence by propagating the Commandments.

What is generally not known to supporters of these bills is the fact that the First and Second Commandments have actually sown the seeds of religious intolerance, disharmony and hatred and inspired communal violence of an epic proportion.

These Commandments have curbed the religious freedom of innocent people who are totally unaware of the existence of the jealous God who delivered people from their bondage in Egypt. These Commandments have provoked and gave legitimacy to the religious persecution of helpless people who never even heard of a prophet by the name of Moses. These Commandments specifically deny an individual’s freedom to choose any god of personal choice and prohibit the right to offer worship to an image or form of one’s liking. These Commandments divide the people into two groups, the believers and the non believers.

In spite of their profound religious philosophy and the strength of spiritual knowledge, the Hindu community landed in the camp of non believers with very tragic consequences.

Unlike the Old Testament, the New Testament has no coercive language, and the ministry of Jesus has been a lot more tolerant of the non believers. Islam which emerged later, gave full recognition to Prophet Abraham and Prophet Moses. Islam only recognized Jesus as a prophet of lesser importance. Their holy book Koran or Quran, vehemently opposes the claim of Jesus to be the son of God.

However, Islam became a very strong and ruthless advocate of the first two of the Ten Commandments. Starting from early 11th century A.D., Muslim forces repeatedly invaded and attacked the people of the Indian subcontinent, for the Muslims hated the Indian people who are known for worshiping idols.

The Muslim armies carried out brutal and vicious campaigns, looting and plundering India with a belief that they were justly punishing people who are non believers. The Muslim attackers destroyed Hindu temples and ruined priceless pieces of art and architecture. The Muslim invaders not only enslaved the Indian people but also built their mosques over the sites where the Hindu temples stood before.

This religious persecution on such a vast scale continued unabated for several centuries.The memories of repression still linger in the minds of the victims and are reflected in the distrust and tension between the Hindu and the Muslim communities of the present day.

If the governor of Indiana decides in favor of displaying the Ten Commandments at public expense, he should omit the first two. He should refrain from promoting a bigoted notion that people who worship idols deserve to be punished, and he should not directly or indirectly infringe on the rights of the religious minorities of his State.

Lord Rama whom I adore, during His life journey described in the epic poem of Ramayana worships His parents, His guru, the River Ganges, the Sun God, Lord Shiva, and others just like any other ordinary mortal being of Indian origin . Gods whom Indians worship participate in similar acts of worship. Lord Shiva worships Lord Rama and Lord Rama worships Lord Shiva.

The Ten Commandments pose a challenge to the survival of the seeds of ideas and thoughts that are planted in the Land of Bharat and the Indian Identity would only exist if people are willing to stand up to this challenge.

The Government of China and it’s Communist Party committed numerous Crimes against Humanity in the name of the Cultural Revolution.

I ask the US citizens to demand the investigation of President Nixon’s Foreign Policy that initiated the US-China relations in 1971-72 without concern for the Crimes Against Humanity described by Communist China as ‘Cultural Revolution’. The Never Ending Saga of Cultural Genocide in Tibet remains as the most important threat to Tibetan National Identity and Tibetan Existence.

Cultural Revolution was designed by Mao Zedong to preserve true Communist ideology by removing capitalist and traditional elements from society in China. Was a move to recover political power by Mao. The movement insisted that revisionists, people in China who promoted capitalism, had to be removed through violent class struggle. Red Guard was a movement of Chinese Youth to perpetuate these goals. Millions of people were persecuted, cultural icons were destroyed, religious sites were ransacked.

In 1966, China’s Communist leader Mao Zedong launched what became known as the Cultural Revolution in order to reassert his authority over the Chinese government. Believing that current Communist leaders were taking the party, and China itself, in the wrong direction, Mao called on the nation’s youth to purge the “impure” elements of Chinese society and revive the revolutionary spirit that had led to victory in the civil war 20 decades earlier and the formation of the People’s Republic of China. The Cultural Revolution continued in various phases until Mao’s death in 1976, and its tormented and violent legacy would resonate in Chinese politics and society for decades to come.

The Cultural Revolution Begins 

In the 1960s, Chinese Communist Party leader Mao Zedong came to feel that the current party leadership in China, as in the Soviet Union, was moving too far in a revisionist direction, with an emphasis on expertise rather than on ideological purity. Mao’s own position in government had weakened after the failure of his “Great Leap Forward” (1958-60) and the economic crisis that followed. Mao gathered a group of radicals, including his wife Jiang Qing and defense minister Lin Biao, to help him attack current party leadership and reassert his authority.

Mao launched the so-called Cultural Revolution (known in full as the Proletarian Cultural Revolution) in August 1966, at a meeting of the Plenum of the Central Committee. He shut down the nation’s schools, calling for a massive youth mobilization to take current party leaders to task for their embrace of bourgeois values and lack of revolutionary spirit. In the months that followed, the movement escalated quickly as the students formed paramilitary groups called the Red Guards and attacked and harassed members of China’s elderly and intellectual population. A personality cult quickly sprang up around Mao, similar to that which existed for Josef Stalin, with different factions of the movement claiming the true interpretation of Maoist thought.

Lin Biao’s Role in the Cultural Revolution

WHOLE VILLAIN: Defense Minister and Communist Party Vice Chairman, the successor of Chairman Mao Tsetung was apparently assassinated by Prime Minister Chou En-lai and Chairman Mao Tsetung on September 13, 1971, as he tried to escape from the country. After his killing, most of the People’s Liberation Army’s Generals of high command were purged. It totally amazes me to know that the US National Security Adviser Henry Kissinger would request Prime Minister Chou En-Lai to launch a military attack on India during that time to stop India from taking military action to resolve the humanitarian crisis in East Pakistan.

 During this early phase of the Cultural Revolution (1966-68), President Liu Shaoqi and other Communist leaders were removed from power. (Beaten and imprisoned, Liu died in prison in 1969.) With different factions of the Red Guard movement battling for dominance, many Chinese cities reached the brink of anarchy by September 1967, when Mao had Lin send army troops in to restore order. The army soon forced many urban members of the Red Guards into rural areas, where the movement declined. Amid the chaos, the Chinese economy plummeted, with industrial production for 1968 dropping 12 percent below that of 1966.

In 1969, Lin was officially designated Mao’s successor. He soon used the excuse of border clashes with Soviet troops to institute martial law. Disturbed by Lin’s premature power grab, Mao began to maneuver against him with the help of Zhou Enlai, China’s premier, splitting the ranks of power atop the Chinese government. In September 1971, Lin died in an airplane crash in Mongolia, apparently while attempting to escape to the Soviet Union. Members of his high military command were subsequently purged, and Zhou took over greater control of the government. Lin’s brutal end led many Chinese citizens to feel disillusioned over the course of Mao’s high-minded “revolution,” which seemed to have dissolved in favor of ordinary power struggles.

Cultural Revolution Comes to an End

Zhou acted to stabilize China by reviving the educational system and restoring numerous former officials to power. In 1972, however, Mao suffered a stroke; in the same year, Zhou learned he had cancer. The two leaders threw their support to Deng Xiaoping (who had been purged during the first phase of the Cultural Revolution), a development opposed by the more radical Jiang and her allies, who became known as the Gang of Four. In the next several years, Chinese politics teetered between the two sides. The radicals finally convinced Mao to purge Deng in April 1976, a few months after Zhou’s death, but after Mao died that September, a civil, police and military coalition pushed the Gang of Four out. Deng regained power in 1977 and would maintain control over the Chinese government for the next 20 years.

Some 1.5 million people were killed during the Cultural Revolution, and millions of others suffered imprisonment, seizure of property, torture or general humiliation. The Cultural Revolution’s short-term effects may have been felt mainly in China’s cities, but its long-term effects would impact the entire country for decades to come. Mao’s large-scale attack on the party and system he had created would eventually produce a result opposite to what he intended, leading many Chinese to lose faith in their government altogether.

Whole Villain – Original Sin: The mockery of the US Constitution. The US National Security Adviser, Dr. Henry A.Kissinger misused and abused his official position to meet foreign Heads of State to develop US foreign relations without the participation of the US Secretary of State. I call this villainous act as Original Sin. Both Chairman Mao Tsetung and Prime Minister Chou En-Lai were leaders of the “Cultural Revolution” during 1966-69 to unleash crimes against humanity.
